The EU VAT directive has two articles (218 and 232) that may affect electronic invoicing, to the extent that it is established as mandatory in certain cases. Both refer to the possibility of issuing or transmitting paper invoices. Therefore, the changes that are intended to be introduced in the electronic invoicing regulations will require Spain to obtain an exception.

The most basic principles on its promotion and obligations are contained in Law 56/2007 . This has been reformed not long ago by Law 18/2022 , colloquially known as the Create and Grow Law . In particular, it has modified article 2.bis to introduce new obligations. However, the arrival of the exception to the aforementioned VAT directive and the regulatory development, pending the drafting of these lines, but whose draft is already known, is expected to come into force .

Furthermore, electronic invoices are still invoices. Therefore, they must comply with all provisions of general regulations, particularly the Value Added Tax Law and the invoicing regulations .
The regulations arising from Law 11/2021 , colloquially known as the Anti-Fraud Law of 2021 , are also somewhat related . This regulation modified many aspects, including certain articles of the General Tax Law , which introduced the so-called anti-fraud software . In December 2023, this reform underwent a regulatory development that materialized in Royal Decree 1007/2023 .
In relations with the Administration, there are specific rules on electronic invoicing. They are contained in Law 25/2013 and its implementing regulations.
